🏠 HOA Rules During Restrictions

North Carolina has no statutory HOA brown-lawn protection equivalent to Texas Property Code Section 202.007 or Colorado House Bill 21-1229. Mecklenburg County HOAs technically retain authority to fine for brown lawns even during mandatory restrictions, but most HOA governing documents include compliance-with-law exemptions that effectively suspend during declared restrictions. Review your HOA governing documents and communicate proactively with the board if you receive a notice.

If your homeowners association sends a violation notice for a dormant or brown lawn during the current restriction period, respond in writing citing the applicable law and include a copy of the current restriction order from Charlotte Water. Most HOAs will rescind the notice once they are made aware of the legal protections in place. If the issue persists, contact your county’s code enforcement division for assistance.

Why These Restrictions Exist

Mecklenburg County is one of four North Carolina counties newly classified by the U.S. Drought Monitor as exceptional drought (D4) in May 2026, the first such classification for this region since 2008. Mountain Island Lake, Charlotte Water's primary intake reservoir, fell to levels not recorded since the 2007-2008 drought. The Catawba-Wateree Drought Management Advisory Group (CW-DMAG) declared Stage 2 of the regional Low Inflow Protocol on May 1, 2026. Charlotte Water aligned its restrictions effective May 15, applying basin-wide to all 1.1 million Mecklenburg County residents across Charlotte and 6 incorporated towns (Cornelius, Davidson, Huntersville, Matthews, Mint Hill, Pineville) plus unincorporated areas.

Rainfall Deficit: Driest October to March on record (since early 1970s) in the Catawba-Wateree basin. Mecklenburg, Cabarrus, Stanly, and Union Counties at D4 exceptional drought, first since 2008.

This deficit has accumulated over the current water year and represents a significant departure from historical averages for the Mecklenburg County area. Water supply reservoirs and aquifer levels are well below seasonal targets, necessitating mandatory conservation measures.
