🏠 HOA Rules During Restrictions

NC law (G.S. 143-355.2) prohibits HOAs from fining for dormant lawns during active mandatory drought restrictions. CW-DMAG Stage 2 LIP supersedes HOA covenants requiring lawn watering outside the assigned schedule.

If your homeowners association sends a violation notice for a dormant or brown lawn during the current restriction period, respond in writing citing the applicable law and include a copy of the current restriction order from City of Conover. Most HOAs will rescind the notice once they are made aware of the legal protections in place. If the issue persists, contact your county’s code enforcement division for assistance.

Why These Restrictions Exist

Conover, NC is part of the Catawba-Wateree River Basin and follows the Low Inflow Protocol coordinated by the Catawba-Wateree Drought Management Advisory Group (CW-DMAG) with Duke Energy. On May 1, 2026 the CW-DMAG escalated the basin to Stage 2 LIP, the first Stage 2 since 2009, and SC and NC utilities began enforcing mandatory restrictions the week of May 5–6, 2026.

Conover is a wholesale water customer of City of Hickory Public Utilities. Stage 2 schedule and rules cascade directly from the wholesaler: residents are bound by City of Hickory Public Utilities's Stage 2 declaration, not by a separate Conover ordinance. Stage 2 mandatory rules

  • Lawn/landscape irrigation: max 2 days/week, 6 PM–6 AM only
  • Odd addresses water Tuesdays and Saturdays; even addresses water Wednesdays and Sundays
  • Residential pools: top-off only Thursdays and Sundays, 6 PM–6 AM (no complete fills)
  • No vehicle washing at home; no power washing; no charity car washes
  • Hand watering, drip irrigation, and soaker hoses: permitted any time outside the 6 AM–6 PM blackout

Goal: reduce regional water use by 5–10%. Drought stage is reviewed on the 1st and 16th of each month.

Conover sits east of Hickory on the I-40 corridor in Catawba County. Founded as a railroad town in 1873 and named after the Conover family who donated land for the depot, it grew on furniture manufacturing and later fiber-optic cable production along the CommScope corridor. The city operates its own billing and ordinance enforcement but does not run a separate water plant, every drop on the Conover system originates at City of Hickory's Catawba-River intake. That makes Stage 2 LIP rules for Conover identical to Hickory's: odd Tue/Sat, even Wed/Sun, 6 PM to 6 AM. Conover City Park, Concordia Lutheran College, and the residential developments off Highway 16 are all on the same wholesale schedule.

Monitor City of Hickory Public Utilities (https://www.hickorync.gov/public-utilities) and duke-energy.com/Community/Lakes/Drought-Management-Advisory for current LIP stage.

Rainfall Deficit: Catawba-Wateree basin escalated to Stage 2 May 1, 2026, first Stage 2 since 2009. Driest October–March on record; D4 Exceptional drought across Mecklenburg, Cabarrus, Stanly, and Union Counties.

This deficit has accumulated over the current water year and represents a significant departure from historical averages for the Conover area. Water supply reservoirs and aquifer levels are well below seasonal targets, necessitating mandatory conservation measures.

How to Keep Your Lawn Alive During Conover Water Restrictions

10 tips tailored for Conover homeowners during Stage 2 LIP Mandatory - In Effect Since May 1, 2026 restrictions.

Stage 2 LIP is in active enforcement in Conover, programme your controller now: odd addresses Tue/Sat, even Wed/Sun, 6 PM–6 AM only.

Hand watering with a shut-off nozzle and drip/soaker hoses are permitted any time outside the 6 AM–6 PM blackout, prioritise mature trees and high-value shrubs over turf.

Tall Fescue (cool-season, common in the foothills/Piedmont) handles summer dormancy well, allow browning rather than stress-watering.

Pool top-ups are limited to Thursdays and Sundays only, 6 PM–6 AM. Filling new residential pools is prohibited.

Vehicle washing at home is prohibited under Stage 2, use a commercial car wash that recycles water. Charity/fundraiser car washes are also banned.

Power washing for non-essential aesthetic purposes is prohibited; surface preparation for paint or repair may still qualify.

Install a rain barrel, captured rainwater is unrestricted at all LIP stages.

Mow at 90–100 mm through summer to shade the soil and reduce evapotranspiration during the 5–10% regional reduction target.

Skip nitrogen fertiliser through September, it forces growth the lawn cannot support during restrictions.

Monitor City of Hickory Public Utilities (https://www.hickorync.gov/public-utilities) and duke-energy.com/Community/Lakes/Drought-Management-Advisory weekly. Stage updates post on the 1st and 16th of each month.

Stage 2 LIP mandatory rules: lawn and landscape irrigation limited to 2 days per week, overnight only (6 PM–6 AM). Odd addresses water Tuesdays and Saturdays. Even addresses water Wednesdays and Sundays. Pools may be topped off Thursdays and Sundays only, 6 PM–6 AM (no full fills). Prohibited under Stage 2: washing vehicles at home, charity/fundraiser car washes, power washing for non-essential purposes, and operating water features that do not support aquatic life. Hand watering, drip irrigation, and soaker hoses remain permitted. Watering outside these hours, even on your scheduled day, is a violation and may result in a citation.
What are the fines for water violations in Conover?
City of Hickory enforces Stage 2 LIP under its Drought Contingency Plan. First-violation fines: $100 (meters ≤1.5") or $200 (meters ≥2"). Second within 12 months: $200/$400. Third: $300/$600. After 5+ violations the utility may disconnect irrigation service. Wholesale customers (Conover, Long View, Maiden) follow the same fine schedule, billed via the local town. The City of Conover (water from City of Hickory wholesale) and local Catawba County enforcement officers conduct patrols and respond to complaints. Keep your irrigation timer set to your assigned day and hours to avoid citations.
Can I install new sod or seed in Conover during restrictions?
Installation of new sod or seed is strongly discouraged during Stage 2 LIP. Variances may be available for newly constructed properties, contact the wholesale utility before installation.
When will water restrictions end in Conover?
The current Stage 2 LIP Mandatory - In Effect Since May 1, 2026 restrictions in Conover are effective from May 1, 2026 Until basin returns to Stage 1 LIP or below (reviewed 1st and 16th monthly). However, the restrictions may be extended if drought conditions persist or eased if significant rainfall improves water supply levels. Monitor the City of Conover (water from City of Hickory wholesale) website for updates.
Am I a City of Hickory customer or a City of Conover customer?
Both, in different ways. Your treated water comes from City of Hickory's Catawba River plant under a wholesale agreement; your monthly bill comes from the City of Conover, which operates the local distribution system and ordinance enforcement. The Stage 2 LIP rules you must follow are set by Hickory under the Catawba-Wateree LIP framework, not by a separate Conover ordinance.
Why does my bill show Conover but the rules come from Hickory?
Wholesale water arrangements separate billing from rule-making. Conover charges you for distribution, metering, and customer service; Hickory sets the source-water conservation rules because they own the intake and treatment plant and answer to the CW-DMAG. During Stage 2 LIP, Hickory's schedule binds every Conover meter, there is no Conover-specific exemption.
Does Conover's industrial sector have separate water-use rules?
Industrial users on dedicated commercial accounts (CommScope, furniture manufacturers, etc.) hold separate permits with both the City of Conover and the NC Department of Environmental Quality. Process water for manufacturing is generally allowed to continue, but landscape irrigation at industrial campuses follows the same Stage 2 schedule as residential customers, odd Tue/Sat, even Wed/Sun, 6 PM to 6 AM only.
How does enforcement work if Hickory water billing and Conover ordinances differ?
Conover Public Works investigates complaints inside city limits and issues citations; Hickory's $100/$200 first-violation fine schedule (per meter size) is applied regardless of which agency writes the ticket. Report water waste to City of Conover at 828-464-1191; Hickory Public Utilities at 828-323-7427 also accepts reports.
What if I'm in Conover but technically on a private well?
Private well owners are not on the City of Hickory wholesale system and are not bound by Stage 2 LIP residential rules. SCDNR-style state water authority does not extend to privately-owned wells in NC. However, voluntary conservation is strongly encouraged because regional groundwater levels are linked, pumping stress on private wells contributes to overall basin drawdown.
Will the I-40 commercial corridor see the same enforcement as residential streets?
Yes. Conover Public Works and Hickory Public Utilities both run patrols along the I-40 corridor (Highway 16 commercial frontage, the McDonald Parkway industrial cluster, and the retail strip near the Hickory border). Commercial landscape sprinklers running at 2 PM on a non-assigned day are an immediate citation regardless of street address.
