🏠 HOA Rules During Restrictions

NC law (G.S. 143-355.2) prohibits HOAs from fining for dormant lawns during active mandatory drought restrictions. Charlotte Water Stage 2 supersedes HOA covenants requiring lawn watering outside the assigned schedule.

If your homeowners association sends a violation notice for a dormant or brown lawn during the current restriction period, respond in writing citing the applicable law and include a copy of the Charlotte Water's current restriction order. Most HOAs will rescind the notice once they are made aware of the legal protections in place. If the issue persists, contact your county’s code enforcement division for assistance.

Why These Restrictions Exist

The Catawba-Wateree Drought Management Advisory Group (CW-DMAG) declared Stage 2 of the Low Inflow Protocol (LIP) on May 1, 2026 – the first Stage 2 since 2009 – covering all 24 counties in the basin (14 NC + 4 SC). Charlotte Water announced its compliance on May 11, 2026 with mandatory Stage 2 restrictions in effect since Friday, May 15, 2026 across all Charlotte Water customers, including Charlotte and the Mecklenburg suburbs of Pineville, Matthews, Mint Hill, Huntersville, Cornelius, and Davidson. This is the first mandatory water restriction in the Charlotte region since the historic 2007–2008 drought.

The goal is to reduce total regional water usage by 5–10%. D4 Exceptional Drought has been introduced into Mecklenburg, Cabarrus, Stanly, and Union Counties – the first time since 2008. Mecklenburg County Parks and Recreation has been under mandatory burn ban since May 4, 2026. Regional partners (Gastonia / Two Rivers Utilities, Lincoln County, Catawba County / Hickory) are under coordinated Stage 2 LIP declarations with their own city-specific schedules.

The driest October-to-March on record (since the early 1970s) drove this escalation. NC Assistant State Climatologist Corey Davis says the current drought shares traits with the 2007 benchmark, which lasted over 460 days and reached Stage 3. Lake Norman and other Catawba-Wateree reservoirs are showing visibly low water levels.
